Terms of Use
Effective October 15, 2026.
Agreement
- These Terms are an agreement between you and Michael Berinshteyn, an independent developer in Erie, Pennsylvania, United States ("we", "us").
- By downloading or playing Tiny Saturn (the "App"), you agree to these Terms and to our Privacy Policy.
- If you do not agree, please do not use the App.
- If you are under 18, or the age of majority where you live, a parent or guardian must agree to these Terms for you.
- Apple's Licensed Application End User License Agreement also applies, and it controls if it conflicts with these Terms on your license to use the App.
Apple
- These Terms are between you and us only, not Apple.
- We, not Apple, are solely responsible for the App and its content.
- Apple has no obligation to provide any maintenance or support for the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple may enforce them against you.
Your license
- We give you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control.
- You may use the App as allowed by the Usage Rules in Apple's Media Services Terms, including Family Sharing.
- You may not copy, modify, sell, rent or distribute the App.
- You may not reverse engineer the App, except where the law allows it.
- You may not cheat, use exploits or tamper with the App to change scores, leaderboards or achievements.
The App is free
- The App is free, with no ads and no in-app purchases.
- We may update, change or stop offering any part of the App at any time.
Health and safety
- Seizure warning: A very small number of people may have seizures or blackouts when exposed to flashing lights or patterns, including in video games. This can happen even to people with no history of seizures or epilepsy.
- If you or anyone in your family has had seizures or epilepsy, talk to a doctor before playing.
- Stop playing right away and see a doctor if you feel dizzy, have blurred vision, eye or muscle twitches, loss of awareness, confusion or any involuntary movement.
- To soften flashing effects, turn on Reduce Motion or Dim Flashing Lights in your device's Accessibility settings, and the App will respect them.
- Take regular breaks, play in a well-lit room and stop if your hands, wrists or eyes feel tired or sore.
- Be aware of your surroundings, and never play while driving or doing anything that needs your full attention.
Fair play and Game Center
- Leaderboards and achievements are provided through Apple's Game Center and its terms.
- We may remove scores that we believe were achieved by cheating.
Content and ownership
- The App, its code, artwork, sounds and design belong to us or our licensors and are protected by law.
- Some parts of the App are used under open licenses, which are listed in Credits inside the App.
- You may share pictures and videos of your own Saturns for personal, non-commercial purposes.
Support
No warranty
- The App is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows.
- We do not promise that the App will be uninterrupted, error-free or always available.
- If the App fails to meet any warranty that applies by law, you may notify Apple, and Apple will refund the price you paid for it, which for this free App is zero.
- To the fullest extent the law allows, Apple has no other warranty obligation for the App.
Limits on our liability
- To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill.
- To the fullest extent the law allows, our total liability for all claims about the App is limited to US $50.
- Some places do not allow these limits, so they may not apply to you, and nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Product claims
- We, not Apple, are responsible for addressing any claims by you or any third party about the App, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and resolving that claim.
Your responsibility
- To the extent the law allows, you agree to cover our reasonable costs if you break these Terms or misuse the App and that leads to a claim against us.
Legal compliance
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country.
- You confirm that you are not on any U.S. Government list of prohibited or restricted parties.
- When you use the App, you must follow any third-party terms that apply, such as Apple's Media Services Terms and Game Center terms.
Resolving disputes
- If you have a problem with the App, please email berinshteyn@gmail.com first, and we will try in good faith to resolve it within 60 days.
- If you live in the United States: any dispute that we cannot resolve informally will be settled by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association, instead of in court.
- Class action waiver: You and we each agree to bring claims only individually, and not as a plaintiff or class member in any class, collective or representative action.
- Either of us may still bring an individual claim in small claims court, and either of us may ask a court to stop infringement of intellectual property.
- You can opt out of arbitration by emailing berinshteyn@gmail.com within 30 days of first accepting these Terms.
- If you live outside the United States, this arbitration section does not apply to you, and you keep any right your local law gives you to bring a claim in your local courts.
Governing law
- These Terms are governed by the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict-of-law rules.
- Any court case allowed under these Terms will be heard in the state or federal courts serving Erie County, Pennsylvania, unless your local law requires otherwise.
- If you are a consumer in the European Union, the United Kingdom or another country with mandatory consumer protection laws, you keep those protections.
Ending these Terms
- You can stop using the App at any time by deleting it.
- Your license ends automatically if you break these Terms.
- The sections on ownership, no warranty, limits on liability, product claims, disputes and governing law continue after these Terms end.
Changes to these Terms
- We may update these Terms from time to time.
- If we do, we will update the date at the top, and significant changes will be mentioned in the App's update notes.
- If you keep using the App after a change takes effect, you accept the updated Terms.
Everything else
- If any part of these Terms cannot be enforced, the rest stays in effect.
- If we do not enforce a part of these Terms, we do not give up the right to enforce it later.
- You may not transfer your rights under these Terms, but we may transfer ours.
- These Terms, the Privacy Policy and Apple's End User License Agreement are the entire agreement between you and us about the App.
