Terms of Service
Agreement
These terms are between you and Michael Berinshteyn and Bryson Mazur (“we”), two individuals in Erie, Pennsylvania. By using Modern IPTV you agree to them and to our Privacy Policy.
Age
You must be 16 or older to use the app. If you're under 18, a parent or guardian must agree to these terms for you.
Only a player
Modern IPTV is a video player and nothing more. We don't operate, sell, host, recommend or endorse any IPTV service, playlist or content, and we aren't affiliated with any provider.
Your TV service is your responsibility
You bring your own provider and enter its login yourself. You're responsible for making sure your subscription, and everything you watch through it, is legal where you live and follows your provider's terms.
Use at your own risk
Streams come from your provider, not from us, and we don't control their quality, availability, legality or content. You use the app and any provider at your own risk, and adult categories stay hidden unless you turn them on.
Acceptable use
Don't use the app to break the law, infringe anyone's rights, redistribute streams, or tamper with, reverse-engineer or overload the app or the services it uses. Answers from Ask come from Apple Intelligence and can be wrong.
Third-party services
The app uses Apple services and information from TMDB, Wikipedia, Wikidata and ESPN, each under its own terms, and we aren't responsible for them. This product uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB. Team names and logos belong to their owners, and Wikipedia text is available under the CC BY-SA license.
Sports information
Schedules, scores and channel matches come from public listings and your provider's own channel names and guide, so they can be wrong or missing. Treat them as a convenience, never as an official schedule.
License
We give you a personal, non-transferable license to use the app on Apple devices you own or control, as Apple's Usage Rules allow. We keep all other rights in the app.
Membership
Modern IPTV needs a yearly membership, sold through Apple as an auto-renewing subscription. New members get the first year free, then pay the price shown in the app (currently $1.00 a year in the US). It renews automatically unless you cancel at least 24 hours before the current period ends, and payment is charged to your Apple Account. Cancel anytime in your Apple Account's Subscriptions settings; you keep access until the period you're in ends. Refunds are handled by Apple. Without an active membership, free trial or place on the free list, the app stays locked, and your saved shows and settings wait for you. The free list is offered at our discretion and can change. An Apple TV linked with an iPhone asks for a new scan once a year.
Copyright
We host and stream no content. If you believe the app itself infringes your rights, email berinshteyn@gmail.com.
No warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T PROMISE THE APP WILL BE ERROR-FREE OR WORK WITH ANY PROVIDER.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE AREN'T LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST DATA, PROVIDER CHARGES OR ANY CONTENT YOU ACCESS, AND OUR TOTAL LIABILITY IS LIMITED TO $50. THIS DOESN'T LIMIT LIABILITY FOR GROSS NEGLIGENCE, RECKLESSNESS, INTENTIONAL MISCONDUCT OR ANYTHING THE LAW WON'T LET US LIMIT.
Indemnification
To the extent the law allows, you agree to cover our reasonable losses and legal fees from claims caused by your breaking these terms or the law, or by content you access with the app.
Apple
These terms are between you and us, not Apple, and Apple isn't responsible for the app or its content. Apple has no duty to provide maintenance or support, and if the app fails a warranty, Apple's only obligation is to refund any price you paid. We, not Apple, handle any claims about the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property. You confirm you aren't in a country under a U.S. embargo or on a U.S. government restricted-party list, and that you'll follow any third-party terms that apply. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
Ending
You can stop using the app at any time and delete your account in Settings. We may end your access if you break these terms, and the sections on warranties, liability, indemnification and governing law continue after that.
Changes
We may update these terms. We'll change the effective date and tell you in the app about important changes, and continuing to use the app means you accept them.
Governing law and venue
Pennsylvania law governs these terms, without regard to conflict-of-law rules. Disputes will be heard only in the Court of Common Pleas of Erie County or the U.S. District Court for the Western District of Pennsylvania, and this doesn't take away any protections your home state guarantees.
The whole agreement
If any part of these terms can't be enforced, the rest still applies. These terms and our Privacy Policy are the entire agreement between us, and not enforcing a term isn't a waiver of it.
