Terms of Service
These Terms are an agreement between you and the developers of OneBrowse, Michael Berinshteyn and Bryson Mazur. By using OneBrowse you agree to them, so if you don't agree, please don't use the app.
1. What OneBrowse is
A web browser that blocks pop-ups, pop-unders, overlays and ads on the sites you pin or browse. It's free, with no subscriptions, in-app purchases or advertising.
2. Who can use it
You must be at least 13, and if you're under the age of majority where you live, a parent or guardian must agree to these Terms for you. You're responsible for how OneBrowse is used on your devices.
3. Websites aren't ours
OneBrowse doesn't host, provide or recommend any website, video or other content, and we don't control or take responsibility for what you reach with it. Your use of a site is between you and that site, under its own terms.
4. Use it lawfully
Use OneBrowse only for lawful purposes, and follow each site's terms and the laws that apply to you. You alone are responsible for what you view, stream or download, including whether you have the right to it.
5. Blocking isn't perfect
Sites change constantly, so some ads and pop-ups will get through, and blocking can stop parts of a site from working. If a site breaks, lower its strength or pause OneBrowse there.
6. Not a security product
OneBrowse doesn't protect against malware, phishing, fraud or tracking by the sites you visit. Don't rely on it for your safety or security.
7. No warranty
OneBrowse is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise it will be uninterrupted, error-free, secure or block any particular thing.
8. Limitation of liability
To the fullest extent the law allows, the developers aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or opportunities. That includes any loss from using, or being unable to use, the app, sync or any site reached through it.
9. Liability cap
To the fullest extent the law allows, our total liability for any claim about OneBrowse is limited to the greater of what you paid for it or 50 US dollars. Some places don't allow these limits, so they apply only as far as your local law permits.
10. Indemnity
You agree to defend and hold harmless the developers from claims, losses and costs, including reasonable legal fees, that come from your misuse of OneBrowse or your breaking these Terms or the law. That includes claims about content you reach through it.
11. Disputes and arbitration
Any dispute about OneBrowse or these Terms will be settled by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, not in court. Either side may instead bring an individual claim in small claims court.
12. No class actions
Claims may be brought only individually, never as a plaintiff or class member in a class, collective or representative action. You and we both give up any right to a jury trial.
13. Opting out of arbitration
You can opt out of arbitration by emailing berinshteyn@gmail.com within 30 days of first using OneBrowse. Where local law doesn't allow these terms, such as in the European Union or the United Kingdom, your consumer rights there still apply.
14. Governing law
These Terms are governed by the laws of Pennsylvania, United States, apart from its conflict-of-law rules. Any claim that isn't arbitrated must be brought in the state or federal courts serving Erie County, Pennsylvania.
15. Your images
Background images you add stay on your device and your own iCloud, and we never receive them. You need the right to use any image you add.
16. The App Store
These Terms are between you and us, not Apple, and we, not Apple, are responsible for OneBrowse and any support or claims about it. Apple's Standard Licensed Application End User License Agreement also applies, and Apple and its subsidiaries may enforce these Terms as third-party beneficiaries.
17. Apple's role
Apple has no obligation to maintain or support OneBrowse, and no warranty obligation beyond any refund the App Store allows. Apple isn't responsible for claims about the app, including product liability, legal compliance or intellectual property claims.
18. Export rules
You confirm you're not in a country under a United States embargo and aren't listed as a prohibited or restricted party. Use OneBrowse only where the law allows it.
19. Ending use
You can stop using OneBrowse and delete it at any time, which removes everything it stored on your device. We may change, suspend or stop offering OneBrowse at any time.
20. Changes
We may update these Terms, and the new version appears here with a new date. Using OneBrowse after that means you accept them.
21. The rest
If any part of these Terms can't be enforced, the rest still applies, and not enforcing a term isn't a waiver of it. These Terms and the Privacy Policy are the whole agreement between you and us about OneBrowse.
